Shortly after Mitchell's accident, we began our mission to change outdated Indiana laws. We fought for laws that require blood testing when there is a fatality or serious bodily injury. We have achieved half of our goal with the recent passing of Indiana HB 1249. Starting July 1, 2026, blood tests will be mandatory when a traffic accident causes a fatality
This new law is a huge victory, however, it does not protect the thousands of serious bodily injury victims harmed by drugged drivers. Nor does it protect those like Mitchell, who are not pronounced dead until hours or in some cases, days after an accident. We are going back to fight to further strengthen this law to include mandatory blood testing for serious bodily injury victims.
Phase two of this proposed legislation would require:
- Mandatory toxicology screening when a traffic accident causes serious bodily injury.
This is about protecting future lives and ensuring that families like Mitchell’s aren’t left without answers and offending drivers are held accountable. Drugged driving is no different than drunk driving so why are the laws different?
